Are you aware of the ordinance in regards to paid sick leave that will impact employers and those in the HR profession within the city of Austin?  Attached is the ordinance as written and below are reasons as to why we currently oppose this ordinance.

  • It mandates benefits for private employers.
  • The city exempted itself from the mandate.
  • Requires monthly reporting of earned and used leave – very burdensome for employers.
  • Requires posting a sign – one more sign no one reads.
  • Employees start earning leave immediately and can use it immediately.
  • They earn 1 hour for every 30 hours worked up to 64 hours per year (8 days).
  • They are not an employee until after working 80 hours, but they earn and can use leave immediately.
  • We suggest they not pass this ordinance because city government should not be mandating private businesses, but if they insist on going forward:
  1. That the mandate be that employees only earn only 3 days per year
  2. That employers can require a probationary period before allowing use of leave of up to 90 days
  3. That the study conduct an economic impact study prior to moving forward with this mandate
  4. Exempt employers with less than 100 employees (they used 15 employees for Fair Chance Hiring)
  5. Eliminate the sign requirement
  6. Eliminate the burdensome reporting
